Project proponents, banks and others as market and regulatory experts have also engaged ACIL Tasman to provide independent advice on market risks and uncertainty.

Most of our experience in this role relates to major infrastructure assets, supporting equity raisings, acquisitions and debt funding of natural gas transmission/distribution pipelines and power station development projects. Our tasks have included responsibility to review or validate assumptions about likely future treatment by regulators, and to present these findings for inclusion in due diligence documents and prospectuses.

Our recent experience includes the following:

  • market analysis under Section 50(3) of the Trade Practices Act
  • prospectus for floats of distribution and transmission businesses
  • due diligence and independent advice for bank financing and loan syndication
  • assistance in the structuring of asset leases.

Having been involved in many of the privatisations of infrastructure and other government services over the past decade, we also have expertise and understanding of the interaction between the public and the private sectors in service provision, including financial sector reform, competition policy and public-private sector partnerships. Financial markets governance and risk management are growing areas of interest.
